Copyright & DMCA Policy

1. How we treat rights
Creators may submit only material they are authorised to use. Where we receive a valid complaint we may remove or disable access to the material, and we terminate the accounts of repeat infringers in appropriate circumstances. We record every notice, what we decided, and how many upheld notices an account has.
What we can remove depends on where the film lives. A Creator Upload is hosted by us and we can remove the file itself. A curated film is hosted by YouTube; we can remove its SHOXA page, but only YouTube can remove the video, through YouTube's own process.
2. Sending a copyright notice
Use the form on this page. A complete notice under the US DMCA contains all of the following:
- Your physical or electronic signature, as the copyright owner or someone authorised to act for the owner.
- Identification of the copyrighted work — or, where several works on SHOXA are covered, a representative list.
- The material you say is infringing and the SHOXA URL where it appears, in enough detail for us to find it.
- Your name, address, telephone number and email address.
- A statement that you have a good-faith belief the use is not authorised by the copyright owner, its agent, or the law.
- A statement, under penalty of perjury, that the information is accurate and that you are the owner of the right, or authorised to act for the owner.
If something is missing we will tell you what it is and ask for it, and we may act on your report in the meantime under our own content rules. A notice that lacks items 1, 5 or 6 does not meet the statutory requirements for a DMCA notification, which means it may not have the effects the DMCA gives a complete notice — it does not mean we will ignore it.
Under 17 U.S.C. § 512(f), knowingly making a material misrepresentation that material is infringing can create liability for damages, including costs and legal fees.
3. Counter-notice
If your film was removed and you believe that was a mistake or misidentification, send a counter-notice from the counter-notice page, containing all of:
- Your physical or electronic signature.
- Identification of the material removed, and where it appeared before removal.
- A statement, under penalty of perjury, that you have a good-faith belief the material was removed or disabled as a result of a mistake or misidentification.
- Your name, address and telephone number, and this statement: "I consent to the jurisdiction of the Federal District Court for the judicial district in which my address is located, or, if my address is outside the United States, the judicial district in which SHOXA may be found, and I will accept service of process from the person who sent the notice or an agent of that person."
Both statements are shown in full on the form. They are not summarised behind a single tick box. Incomplete counter-notices are handled the same way as incomplete notices: we tell you what is missing.
4. What happens next
On a valid notice we remove or disable the material and tell the uploader, passing on its substance.
On a valid counter-notice we forward a copy to the person who sent the original notice and tell them the material may be restored. Under the US DMCA process, restoration is generally no earlier than 10 and no later than 14 business days after we receive a valid counter-notice, unless the complainant tells us first that they have filed a court action seeking to restrain the activity.
We will not restore material where a separate valid legal or policy reason for removal applies. Restoration is not automatic in every case.
5. Designated agent
Copyright notices should be sent through the form on this page. SHOXA has not designated an agent with the US Copyright Office. We do not claim the protection of the US DMCA safe harbour, and we will not say otherwise on this page unless and until that registration is completed.
6. Complaints that are not about copyright
For trademark, privacy, likeness, impersonation or defamation, use the report action on the film page or the general report form. Do not use the copyright form: it asks you to swear a statement about copyright ownership that would not be true.
7. Curated films and claiming a film
If you hold rights in a film shown here through the YouTube player and want its SHOXA page removed, a short message identifying yourself and the film is enough. You do not need a full DMCA notice for that.
If you would rather take over the page as its creator, use "Claim this film". You send us evidence and an administrator decides. We review what you send; we have no technical means of confirming that you control a YouTube channel, and control of a page is never transferred automatically.
We do not download, re-host, edit, strip branding from, or bypass restrictions on third-party videos, and we no longer alter the artwork of curated films to obscure anything in it.
